Scope
1.1 This limited warranty is issued by Crestron Electronics, Inc. together with its subsidiaries and affiliates, excluding Crestron Europe BV, (collectively, “Crestron”), and is applicable only to: Crestron residential lighting dimmers and switches, sensors, keypads, lighting enclosures, terminal blocks, power supplies, thermostats, and control processors (collectively, “Covered Products”) when dedicated for use as part of a residential lighting control system (“Covered System”), and only to such Covered Products purchased by or on behalf of the original end-customer (“Customer”) directly from Crestron, an authorized Crestron dealer, or other reseller authorized by Crestron (collectively, “Authorized Reseller”). This warranty shall not extend to subsequent owners or be transferred or assigned.

1.2 This warranty is a limited warranty and gives you specific legal rights. You may also have additional rights under applicable law, which vary from jurisdiction to jurisdiction, and this limited warranty does not affect such rights. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the limitation or exclusion under this limited warranty may not apply to you.

1.3 This warranty extends to only those Covered Products which are purchased from Crestron and installed by an Authorized Reseller for residential use on or after July 1st, 2016.

1.4 Batteries and lamps are not warranted by Crestron under this or any other warranty. This limited warranty also expressly excludes: touchscreens, faceplates, circuit breakers, Ethernet switches, lighting fixtures, ballasts, LED drivers, all products comprised of third-party branded microcomputers, sold with Crestron software preinstalled and preconfigured (“Computer Products”), including without limitation VC-4-PC-3, and any product not dedicated for lighting control purposes. 1.5 This warranty applies in the territory where the Covered Products are distributed by Crestron, via an Authorized Reseller.

1.6 Customer acknowledges and agrees that use of the Covered Products or Covered System, or any part thereof, constitutes acceptance of all terms and conditions of this warranty. Any subsequent addition to the Covered System provided by Crestron will be governed by a separate limited warranty issued at the time of purchase.

2. Limited Warranty
2.1 Subject to the exclusions and restrictions in this warranty, Crestron warrants that if any Covered Product is found to exhibit defects in material or workmanship under normal use within the lifetime of the Covered Product, which commences on the Covered Product’s Launch Date and continues until the Covered Product’s End of Maintenance Date as set forth in Crestron’s End of Sale Notice, Crestron will, at its sole discretion, either: (a) provide a replacement product; (b) repair the defective Covered Product; or (c) issue a credit against the purchase price of a comparable replacement product purchased from an Authorized Reseller; provided that Customer promptly notifies Crestron of the defect via an Authorized Reseller and arranges for the return of the defective Covered Product.

2.2 Any Covered Product that has been replaced or repaired may be, in whole or in part, new, used, repaired, reconditioned, refurbished, and/or made by a different manufacturer. The warranty period for any replaced or repaired Covered Product shall be limited to the unexpired portion of the warranty on the originally purchased Covered Product.

2.3 Certain Covered Products include operational software and firmware (collectively, the “Software”). Subject to the provisions of Section 2.1 above, such Software is governed by the Crestron Software End-User License Agreement, which can be found at: https://www.crestron.com/Crestron-Software-End-User-License-Agreement.

3. Terms and Conditions of Limited Warranty
3.1 Customers should inquire of the Authorized Reseller, from whom they purchased the Covered Product or Covered System, regarding the nature and extent of that Authorized Reseller’s warranty, if any. Crestron, however, shall not be responsible for any such Authorized Reseller’s warranty. This warranty does not cover, and Crestron is not responsible for labor costs to diagnose, remove, repair, replace, reinstall, and/or program any Covered Product or Covered System.

3.2 This warranty shall be null and void, and Crestron shall have no liability under the terms of this warranty, if the Covered Product or Covered System has been used in an application or environment other than that for which it was intended, or if the damage to the Covered Product or Covered System resulted from normal wear and tear or was caused by misuse, abuse, accidental or intentional damage, modification, alteration, disassembly, improper repair or installation, abnormal stress or operating conditions, or adverse environmental factors, including, but not limited to: exposure to the elements (such as sun, wind, water, moisture, humidity, or salt), discoloration, fading, or deterioration over time; operation outside of indicated electrical values or use of incorrect line voltages, improper wiring, improperly rated fuses or circuit breakers; improper or insufficient ventilation or incorrect temperatures; failure to maintain equipment under the specified temperature limits; use of incompatible devices, accessories, or cables not approved by Crestron; failure to install, repair, maintain, or operate the Covered Product or Covered System pursuant to the operating instructions or technical information provided by Crestron; failure to comply with the provisions of applicable electrical or other building codes, safety standards, regulations, or laws; relocation of the Covered Products or Covered System to another physical location; or other events beyond Crestron’s control, such as, but not limited to, acts of the Authorized Reseller, Customer, end user, or another third party, or an act of God. This warranty does not cover any Covered Product that has had the serial number altered, defaced, or removed.

3.3 THIS WARRANTY SHALL BE THE SOLE AND EXCLUSIVE REMEDY TO CUSTOMER. IN NO EVENT SHALL CRESTRON BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (PROPERTY OR ECONOMIC DAMAGES INCLUSIVE) ARISING FROM THE SALE OR USE OF THE COVERED PRODUCT, THIS WARRANTY, OR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY. CUSTOMER ASSUMES, AND WILL HOLD CRESTRON HARMLESS, WITH RESPECT TO ALL SUCH LOSSES. Crestron’s liability on any claim for damages arising out of or in connection with this warranty or the manufacture, sale, installation, delivery, use, repair, or replacement of the Covered Product shall never exceed the purchase price of the Covered Product. Crestron is not liable for any claim made by a third party or made by Customer for a third party.

3.4 Further, Crestron shall have no liability for any claims of infringement of any patent, trademark, copyright or other intellectual property for the following: (a) to the extent the claims relate to the use of the Covered Product in combination with any third party product; (b) if the Covered Product was modified by anyone other than Crestron; (c) for the use or sale of the Covered Product other than as specified and authorized in Crestron’s documentation; or (d) for the use or sale of any version of Crestron software other than the most current version.

3.5 EXCEPT AS EXPRESSLY SET FORTH IN THIS WARRANTY, CRESTRON MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, NOR AUTHORIZES ANY OTHER PARTY TO OFFER ANY WARRANTY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE DURATION OF ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY LAW, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IS EXPRESSLY LIMITED TO THIS WARRANTY PERIOD.

3.6 This warranty supersedes any and all previous warranties and Crestron’s obligations under any implied warranties shall be limited to the terms of this express warranty. Crestron reserves the right to amend this warranty from time to time. However, to the extent that any amended warranty materially changes Crestron’s warranty obligations, such amendments will not apply to Covered Product orders already placed and accepted by Crestron.

4. To Make a Warranty Claim
4.1 To make a warranty claim, promptly notify Crestron by contacting the Customer Support Center at support@crestron.com or visit our website at www.crestron.com to obtain additional local contact information. You may also contact your Authorized Reseller. Crestron, in its sole discretion, will determine what action, if any, is required under this warranty. No Covered Products may be returned for credit, exchange, repair, or replacement without prior written authorization from Crestron. If your products are authorized for return, Crestron or your Authorized Reseller will provide further instruction regarding the Return Material Authorization (“RMA”) process. Covered Products may not be returned without an RMA number. The claimed defects are subject to validation by Crestron technical support personnel. Shipping charges may apply.

4.2 Most problems can be corrected over the phone through close cooperation between Customer, Authorized Reseller, and the Crestron Customer Support Center. To better enable Crestron to address a warranty claim, please have the Covered Product’s serial and model numbers as well as its current operating system version, if applicable. If Crestron, in its sole discretion, determines that an on-site visit or other remedial action is necessary, Crestron may assist the Customer in coordinating such action with an Authorized Reseller.

5. Governing Law and Dispute Resolution
5.1 This warranty shall be governed by and construed in accordance with the laws of the State of New Jersey, United States of America, without regards to conflict of laws principles. The United Nations Convention on the International Sale of Goods shall not apply. If any portion hereof is found to be void or unenforceable, the remaining provisions of the warranty shall remain in full force and effect.

5.2 In the event of any dispute arising between the parties in connection with or relating to this warranty, the parties agree that such dispute shall be resolved amicably, if possible.

5.3 Failing an amicable resolution, disputes shall be brought as follows:

(a) For disputes regarding products distributed by Crestron Electronics, Inc., those disputes shall be brought before the US Federal District Court, District of New Jersey or Superior Court of New Jersey, Bergen Civil Division;

(b) For disputes regarding products distributed by Crestron ANZ Pty. Ltd., those disputes shall be brought before the courts of New South Wales (Australia); and

(c) For disputes regarding products distributed by Crestron Singapore Pte. Ltd., those disputes shall be brought before the Singapore Courts.

New Savant Product Limited Warranty

Scope

This document contains terms and conditions of use by the end user/purchaser and the limited warranty obligation of Savant Systems, Inc. (“Savant”) for hardware Products (“Product”) purchased through an authorized Agent of Savant (“Agent”) or directly from Savant. Separate software licensing and support agreements are available from your Savant Authorized Agent. The installation and use of the Products, including any and all Savant components indicate that the end user/purchaser agrees to be bound by these terms. All Savant Products are sold with a basic limited warranty.

Hardware Product Limited Warranty

All Savant Products have a limited two (2) year repair or replace warranty for products that do not substantially conform to the applicable specifications provided with such product or as are made available by Savant.

Additional Warranty Periods and Product-Specific Remedies:

  • Savant Power Storage has a ten (10) year or 73 MWh of throughput (equivalent to 3,650 cycles), whichever is sooner, limited warranty period, with at least a 75% retention of battery capacity over the warranty period, for products that do not substantially conform to the applicable specifications provided with such product or as are made available by Savant. Savant Power Storage Products with a valid warranty claim within the warranty period will, at Savant’s election, be (a) repaired, (b) replaced with an equivalent product, or (c) the warranty claimant may purchase replacement Product from Savant (or Savant’s designee) at a discounted rate equivalent to the MSRP of the replacement Product minus depreciation based on the amount of the warranty period remaining.
  • Savant Power Modules have a five (5) year limited repair or replace warranty period for products that do not substantially conform to the applicable specifications provided with such product or as are made available by Savant.
  • Savant Shade bracketing systems and fabric have a limited five (5) year repair or replace warranty for products that do not substantially conform to the applicable specifications provided with such product or as are made available by Savant.
  • Artison sound bars, architectural speakers and custom grilles have a limited five (5) year repair or replace warranty for products that do not substantially conform to the applicable specifications provided with such product or as are made available by Savant.
  • Savant Lighting low voltage keypads and power supplies, lighting modules and panel bridge controllers have a limited five (5) year repair or replace warranty for products that do not substantially conform to the applicable specifications provided with such product or as are made available by Savant.
  • Items purchased after the Product Discontinuation Date have a 90-day limited warranty.

NOTE: Warranty excludes any Product that is not maintained in accordance with Savant’s maintenance recommendations, is operated in a manner other than that specified by Savant, is damaged from misuse, abuse, accidental damage, modifications, improper wiring, improper repair or operation outside of specified operating temperatures, or is damaged from outside forces such as humidity, weather, or electrical surges.

Conditions of warranty service are as follows:

  • This New Savant Product Limited Warranty extends to the end user of the Product, provided the Product was installed, configured and serviced by a Savant Authorized Agent and has not been relocated from its original installation site.
  • Warranty claims must be made to Savant or a Savant Authorized Agent.
  • Upon receiving a written notice of warranty claim, Savant will issue to the Agent a Return Material Authorization (“RMA”) number.
  • Covered Hardware is tracked by serial number and must be shipped (prepaid) to Savant’s repair facility. Original packaging and adequate overpacking for shipping, or equivalent proper packing, must be utilized to prevent damage. Savant’s standard time to repair and ship RMA Products is thirty (30) days from receipt at Savant’s repair facility. Upon receipt of the RMA Product, Savant shall inspect and test it. If Savant, in its reasonable judgment, determines that the Product is defective, Savant shall, if possible, repair the hardware. At Savant’s option, it may choose to replace the covered Product with an equivalent (new or factory refurbished) Product. If the Product is replaced, the returned Product material will become the property of Savant. All factory-repaired Products shall be tested before returning to the Agent. Repaired material shall be shipped by Savant to the Agent, EXW (Ex Works) SAVANT.
  • The New Savant Product Limited Warranty commences upon the date of shipment from Savant.
  • Repaired or replaced Product will be warranted for the remainder of the Products’ original Warranty Period, or ninety (90) days, whichever is longer.
  • Separate “no trouble found” charges may apply for Product returned under the warranty for repair that is determined to be in good working order. Costs are limited to shipping, handling, testing, and administrative expenses.

3rd Party Warranty

For 3rd party devices purchased through the Savant Store, check the individual product page for detailed information about warranty coverage.

Warranty Exclusions

  • This warranty does not cover the cost of Product installation, removal, or reinstallation.
  • This warranty shall be the sole and exclusive remedy to the end user of the Product provided the Product was installed, configured and serviced by a Savant Authorized Agent and has not been relocated from its original installation site. In no event shall Savant be liable for incidental or consequential damages of any kind.
  • This warranty does not cover any Product that has had the serial number in any way tampered with, removed, or altered.
  • Savant reserves the right to reject any RMA Product that fails to meet any and all the limitations of the Basic Limited Warranty defined herein.
  • The warranty does not include Savant Authorized Agent Services. This includes the following:
    • Savant’s assistance in diagnostic efforts
    • Access to Savant’s technical support websites, databases, or tools
    • Product integration testing
    • On-site assistance
    • Product documentation updates
  • Expendable items, including, without limitation, field-replaceable batteries, fuses, light bulbs, motor brushes, or similar consumables.
  • Normal wear and tear, abuse, misuse, incorrect installation, neglect, accident, interference or environmental factors.
  • All Products must be returned in original packaging. Products returned and damaged due to mis-packaging will be considered out-of-warranty. Installation kit charges may be applied, if not returned with the defective Product.
  • Fabric that is not installed within 30-days of shipment is not covered under warranty. Fabric must be installed within 30-days to avoid fabric damage.

Terms and Conditions of Limited Warranty

THE WARRANTIES SET FORTH IN THIS DOCUMENT ARE EXCLUSIVE AND ARE GRANTED IN LIEU OF ALL OTHER EXPRESS AND IMPLIED WARRANTIES (WHETHER WRITTEN, ORAL, STATUTORY OR OTHERWISE), INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. AGENTS SOLE AND EXCLUSIVE REMEDY AND SAVANT’S SOLE OBLIGATION HEREUNDER, SHALL BE TO REPAIR, REPLACE, CREDIT, OR REFUND AS SET FORTH ABOVE. IN NO EVENT SHALL SAVANT, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES, BE LIABLE FOR ANY COSTS OR DAMAGES ARISING DIRECTLY OR INDIRECTLY FROM AGENT’S OR END USER’S USE OF ANY PRODUCT INCLUDING ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, MULTIPLE, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHER LEGAL THEORY, EVEN IF SAVANT, OR ANY OF ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, SAVANT’S CUMULATIVE LIABILITY FOR ANY AND ALL CLAIMS RELATING TO THE USE OF ANY PRODUCT SHALL NOT EXCEED THE TOTAL AMOUNT OF THE PURCHASE PRICE OR LICENSE FEES PAID TO SAVANT FOR SUCH PRODUCT.

3.4 Further, Crestron shall have no liability for any claims of infringement of any patent, trademark, copyright or other intellectual property for the following: (a) to the extent the claims relate to the use of the Covered Product in combination with any third party product; (b) if the Covered Product was modified by anyone other than Crestron; (c) for the use or sale of the Covered Product other than as specified and authorized in Crestron’s documentation; or (d) for the use or sale of any version of Crestron software other than the most current version.

3.5 EXCEPT AS EXPRESSLY SET FORTH IN THIS WARRANTY, CRESTRON MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, NOR AUTHORIZES ANY OTHER PARTY TO OFFER ANY WARRANTY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE DURATION OF ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY LAW, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IS EXPRESSLY LIMITED TO THIS WARRANTY PERIOD.

3.6 This warranty supersedes any and all previous warranties and Crestron’s obligations under any implied warranties shall be limited to the terms of this express warranty. Crestron reserves the right to amend this warranty from time to time. However, to the extent that any amended warranty materially changes Crestron’s warranty obligations, such amendments will not apply to Covered Product orders already placed and accepted by Crestron.

4. To Make a Warranty Claim
4.1 To make a warranty claim, promptly notify Crestron by contacting the Customer Support Center at support@crestron.com or visit our website at www.crestron.com to obtain additional local contact information. You may also contact your Authorized Reseller. Crestron, in its sole discretion, will determine what action, if any, is required under this warranty. No Covered Products may be returned for credit, exchange, repair, or replacement without prior written authorization from Crestron. If your products are authorized for return, Crestron or your Authorized Reseller will provide further instruction regarding the Return Material Authorization (“RMA”) process. Covered Products may not be returned without an RMA number. The claimed defects are subject to validation by Crestron technical support personnel. Shipping charges may apply.

4.2 Most problems can be corrected over the phone through close cooperation between Customer, Authorized Reseller, and the Crestron Customer Support Center. To better enable Crestron to address a warranty claim, please have the Covered Product’s serial and model numbers as well as its current operating system version, if applicable. If Crestron, in its sole discretion, determines that an on-site visit or other remedial action is necessary, Crestron may assist the Customer in coordinating such action with an Authorized Reseller.

5. Governing Law and Dispute Resolution
5.1 This warranty shall be governed by and construed in accordance with the laws of the State of New Jersey, United States of America, without regards to conflict of laws principles. The United Nations Convention on the International Sale of Goods shall not apply. If any portion hereof is found to be void or unenforceable, the remaining provisions of the warranty shall remain in full force and effect.

5.2 In the event of any dispute arising between the parties in connection with or relating to this warranty, the parties agree that such dispute shall be resolved amicably, if possible.

5.3 Failing an amicable resolution, disputes shall be brought as follows:

(a) For disputes regarding products distributed by Crestron Electronics, Inc., those disputes shall be brought before the US Federal District Court, District of New Jersey or Superior Court of New Jersey, Bergen Civil Division;

(b) For disputes regarding products distributed by Crestron ANZ Pty. Ltd., those disputes shall be brought before the courts of New South Wales (Australia); and

(c) For disputes regarding products distributed by Crestron Singapore Pte. Ltd., those disputes shall be brought before the Singapore Courts.
